By accessing our website or signing up for our coaching services, you agree to these Terms. If you don't agree, please don't use our services (but we'd miss you).
Please read this carefully—it's written to be as friendly as possible while keeping us all legally protected.

2. Acceptance of Terms
By using our website, booking services, or participating in any coaching programs, you're agreeing to these Terms and Conditions, our Privacy Policy, and any other policies we post on our website. If you're under 18, you'll need a parent or guardian's consent to use our services (because we take safety seriously, even if squats are fun).
3. Services Offered
We provide personal training, fitness coaching, health consultations, and related wellness services—both in-person and online. Services may include:
One-on-one personal training sessions
Group fitness classes
Customized fitness programming and coaching
Nutritional guidance (general wellness, not medical advice)
Progress tracking and accountability support
Online coaching via video calls, apps, or digital platforms
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
4. Health and Medical Disclaimer
READ THIS CAREFULLY—IT'S IMPORTANT:
You acknowledge and agree that:
Holistic Fitness LLC and its trainers are not licensed medical professionals, physicians, physical therapists, or registered dietitians. We provide fitness coaching and general wellness guidance only.
Our services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician before starting any new fitness program, especially if you have pre-existing health conditions, injuries, or are pregnant.
You are solely responsible for determining whether our services are appropriate for your health and fitness level.
Participation in physical exercise carries inherent risks, including but not limited to muscle strains, sprains, broken bones, heart attack, heat exhaustion, and in rare cases, death.
You voluntarily assume all risks associated with participating in our programs and release Holistic Fitness LLC from liability for injuries arising from your participation (except in cases of our gross negligence or intentional misconduct—see Section 7).
If you experience pain, dizziness, shortness of breath, or discomfort during exercise, STOP IMMEDIATELY and seek medical attention.
5. User Responsibilities
When you use our services, you agree to:
Provide accurate and complete health information, including any injuries, medical conditions, or physical limitations that may affect your ability to exercise safely.
Follow all instructions and recommendations provided by your trainer, and inform us immediately if an exercise feels unsafe or causes pain.
Use equipment properly and safely (we'll teach you how, but you need to listen).
Respect our trainers, other clients, and our facilities (virtual or physical).
Not share, reproduce, or distribute our proprietary training programs, materials, or content without written permission.
Keep your account login credentials confidential and notify us immediately of any unauthorized use.
6. Payments, Cancellations, and Refunds
Payment Terms
All fees must be paid in advance unless otherwise agreed in writing.
We accept payments via Stripe, GoHighLevel, cash, Venmo, Cash App, and bank transfer. By providing payment information, you authorize us to charge your account for all agreed-upon fees.
Billing Options: We offer flexible billing for (1) individual sessions paid per session, (2) 4-week billing cycles, or (3) prepaid packages with upfront payment.
Prices are subject to change with 30 days' notice for ongoing services.
Cancellation and Rescheduling Policy
Sessions: You may cancel or reschedule individual sessions with at least 72 hours' advance notice without penalty. Cancellations or reschedules made with less than 72 hours' notice, or no-shows, will result in forfeiture of that session or a cancellation fee equal to the full session cost.
Programs/Packages: Monthly or multi-session packages require 14 days' written notice for cancellation. Cancellations will be effective at the end of the current billing cycle.
Special Circumstances: We may grant exceptions for medical emergencies, injury (doctor's note required), relocation more than 25 miles from Jackson, WY, or other extenuating circumstances at our sole discretion.
Refund Policy
No refunds are provided for completed sessions or services already rendered.
For prepaid packages, refunds may be issued on a prorated basis (minus a 10% administrative fee and the value of any sessions used) in cases of serious injury, illness, or relocation (documentation required).
Refunds are processed within 30 days to the original payment method.
Money-back guarantee: If you're not satisfied after your first session, contact us within 7 days for a full refund—no questions asked (except maybe "how can we improve?").
7. Limitation of Liability and Assumption of Risk
By using our services, you acknowledge and agree:
Physical exercise involves inherent risks, and you voluntarily assume all such risks.
Holistic Fitness LLC, its owners, trainers, employees, and agents are not liable for any injuries, damages, or losses you suffer arising from your participation in our programs, except in cases of our gross negligence, willful misconduct, or intentional harm.
"Gross negligence" means reckless disregard for your safety (e.g., forcing you to lift a weight that's clearly dangerous and causes injury due to our disregard for safety protocols). Ordinary negligence (like a minor equipment malfunction) is covered by this waiver, but gross negligence is not.
You release us from liability for any claims, demands, or lawsuits arising from your use of our services, facilities, or equipment.
Our total liability to you for any claims, regardless of the form of action, will not exceed the amount you paid for services in the 12 months prior to the claim.
This limitation of liability does not apply where prohibited by law.
8. Intellectual Property Rights
All content on our website and in our programs—including text, graphics, logos, images, videos, training plans, and other materials—is the exclusive property of Holistic Fitness LLC and protected by copyright, trademark, and other intellectual property laws.
You may not:
Copy, reproduce, distribute, modify, or create derivative works from our content without written permission.
Use our trademarks, logos, or branding without authorization.
Share, sell, or redistribute our training programs or proprietary materials.
You may:
Use our content for personal, non-commercial purposes as part of your coaching program.
Share your success stories and tag us on social media (we love that!).
User-Generated Content: If you provide testimonials, photos, videos, or other content to us, you grant Holistic Fitness LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and promotional purposes (by enrolling in our services, you grant your permission).
9. Use of Name, Likeness, and Testimonials for Marketing
By participating in our services, you grant Holistic Fitness LLC the right to use your name, likeness, photographs, videos, testimonials, and transformation stories for marketing, advertising, promotional, and educational purposes across all media platforms (including but not limited to our website, social media, printed materials, and advertisements).
We believe your inspiring stories and testimonials help other people like you change their lives for the better. Your journey can motivate others to take the first step toward their own transformation.
Your Rights:
You may request anonymity or use of a pseudonym instead of your full name by providing written notice to [email protected].
You may withdraw your consent and request removal from marketing materials at any time by sending written notice to [email protected]. We will remove your content from future marketing within 30 days of receiving your request (content already distributed or published may remain in circulation).
You may opt out entirely from being featured in any marketing materials by notifying us in writing at the time of service enrollment or anytime thereafter.
By consenting to the use of your name, likeness, or testimonials, you waive any right to royalties, compensation, or other payment related to such use.
10. Privacy and Data Protection
We take your privacy seriously. Please review our Privacy Policy (link to your Privacy Policy page) for details on how we collect, use, and protect your personal information, including health data.
By using our services, you consent to our collection and use of your information as described in the Privacy Policy.
11. Online Services and Technology
For online coaching, video sessions, and digital platforms:
We are not responsible for technical issues, internet connectivity problems, or equipment failures on your end.
You are responsible for ensuring a safe exercise environment in your home or location.
Video sessions may be recorded for quality assurance and training purposes with your consent. Recordings will be kept confidential and deleted according to our data retention policy.
12. Confidentiality and Client Information
Your health information and personal details are confidential, and we will not share them without your permission, except:
When required by law.
With your explicit consent for use in anonymized testimonials, success stories, or marketing materials (see Section 9).
To process payments or fulfill services (e.g., sharing with payment processors like Stripe).
We may occasionally ask to share your progress, story, or transformation for motivational purposes—but only with your written permission.
13. Termination of Services
We reserve the right to terminate or suspend your access to our services at any time if you:
Violate these Terms and Conditions.
Provide false or misleading information.
Engage in abusive, disrespectful, or illegal behavior.
Fail to pay for services.
You may terminate your services at any time by following our cancellation policy (see Section 6).
14. Minors and Parental Consent
We primarily serve adults aged 18 and older. Minors (under 18) may participate only with written parental or guardian consent and supervision. Parents/guardians are responsible for their minor's compliance with these Terms and assume all liability on their behalf.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
Good Faith Dispute Resolution Process
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of our services, both parties agree to the following dispute resolution process:
Step 1: Seek First to Understand
Both parties commit to engaging in good faith communication by first seeking to understand the other party's perspective. Each party agrees to actively listen, repeat back what the other party has communicated to ensure mutual understanding, and clarify any misunderstandings before proceeding.
Step 2: Seek to Be Understood
After demonstrating understanding of the other party's position, each party may then seek to be understood by clearly articulating their own concerns, interests, and desired outcomes in a respectful and constructive manner.
Step 3: Collaborative Problem-Solving
Both parties agree to work collaboratively toward finding the best win-win outcome for all parties involved, prioritizing mutual benefit, fairness, and long-term relationship preservation over adversarial positioning.
Step 4: Informal Resolution
If the dispute cannot be resolved through the process outlined above, please contact us at [email protected]. We'll work in good faith to resolve it informally within 30 days.
Step 5: Binding Arbitration
If we cannot resolve the dispute informally after completing the good faith resolution process, both parties agree to binding arbitration under the Wyoming Uniform Arbitration Act (W.S. 1-36-101 et seq.) in Teton County, Wyoming. The arbitrator's decision will be final and binding.
No Class Actions: You agree to resolve disputes individually and waive your right to participate in class-action lawsuits or class-wide arbitration.
Exceptions: Either party may seek injunctive relief in court for intellectual property violations or breaches of confidentiality without first engaging in the dispute resolution process outlined above.
This dispute resolution process and arbitration clause are enforceable under Wyoming law and the Federal Arbitration Act.
16. Disclaimers and Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
Warranties of fitness for a particular purpose, merchantability, or non-infringement.
Guarantees of specific results or outcomes (your results will vary based on effort, consistency, genetics, and other factors).
We do not guarantee that our website or services will be uninterrupted, error-free, or free from viruses or harmful components.
17. Indemnification
You agree to indemnify, defend, and hold harmless Holistic Fitness LLC, its owners, trainers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of our services.
Your violation of these Terms.
Your violation of any third-party rights, including intellectual property rights.
18. Modifications to Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes:

We'll notify you via email or website notice at least 14 days before changes take effect (for material changes).
Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.

19. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed and deleted from these Terms.
All remaining provisions shall continue in full force and effect to the maximum extent permitted by law. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and these Terms shall be construed as if the invalid or unenforceable provision had never been included.
This severability clause ensures that the agreement as a whole remains binding and operational even if one part is legally dismissed or found unenforceable.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other policies posted on our website or visibly at our location, sent to the client, or handed in person, constitute the entire agreement between you and Holistic Fitness LLC regarding your use of our services and supersede all prior agreements and understandings.
